Privacy Policy For Services Provided by GetAt Inc. and the Get@ mobile app 


Effective: March 1, 2017


This Privacy Policy is applicable to your use of our websites in our domains getat.co and getatapp.com and their subdomains belonging to GetAt Inc. (“we,” “our,” or “us”), and the Get@ mobile application ("Get@") created by GetAt Inc. that you, the user, have downloaded (collectively, the “Services”). The Policy is also applicable to our use of the information about user identity and content (including Signup and Login information provided by you, Collections, Items, uploaded image and document files, etc., collectively the "User Content") and other information about user experience and interactions (including "My Channels" messages, time-stamped Activities and app and webpage screen interactions, button taps and clicks, etc., collectively "Data") that you provide through sign-up to establish a Get@ account and your continued use of our Services. 


How We Collect and Use Information


We collect the following types of information about you:


Information you provide us directly:


We ask for certain information such as your username, full name, phone number and e-mail address when you sign up for a Get@ Account, and these are stored on our servers when you enter the information, either at that time or later when you add or modify the information in your profile. Any profile photo(s) and other photos and documents that you upload are also stored on our servers. We may also retain any messages you send through the Services to other Get@ users using our "My Channels" messaging service, and may collect User Content that you create, upload or post to the Services. We use this information to operate, maintain, and provide to you the features and functionality of the Services. Your username and if you choose to enter it, your full name (which may be your real name), will be published publicly. Once published, your profile information including your username, your full name, and any profile and cover images that you have uploaded may not be able to be removed and deleted from our server databases or from other users' data stores on their devices that can be accessed by Get@ and other apps.


Information we may receive from third parties:


We may receive information about you from third parties. For example, it may be possible to access our Services through a third-party connection or login. That third party may pass certain information about your use of its service to Get@. This information could include, but is not limited to, the user ID associated with your third-party account (for example, your Facebook UID), an access token necessary to access that service, any information that you have permitted the third party to share with us, and any information you have made public in connection with that service. Furthermore, if you allow us access to your friends list, your friends’ user IDs, and your connection to those friends, may be used and stored to make your experience more social, and to allow you to invite your friends to use our Services as well as provide you with updates if and when your friends join Get@. You should always review, and if necessary, adjust your privacy settings on third-party websites and services before linking or connecting them to our Services. If you wish to do so, it is your responsibility to unlink your third party account from the Services by adjusting your settings on the third party service.


Inviting a friend to use Get@:


GetAt Inc. has developed, or may, at its sole discretion, develop a feature for Get@ that allows you to invite third parties to the Services. You understand that by inviting friends (persons in your Contacts list) to Get@ through the “Invite friends” feature, an invitation will be sent out on your behalf using a third party bulk SMS service provided by Twilio Inc., with your name and other identifying information, along with recipients' phone numbers, sent securely to Twilio for this purpose via our server. This privacy of this information once it is received by Twilio is governed by their privacy policy (https://www.twilio.com/legal/privacy) over which we have no control, and you understand and agree that by using this service to invite friends to download and use Get@, you permitting this information to be transmitted to Twilio's servers and then become subject to their privacy policy so that the SMS invite can be sent out.


Finding your friends on the Services:


GetAt Inc. has developed, or may, at its sole discretion, develop a feature for Get@ that allows you to locate your friends with Get@ accounts through a “Find friends” option. The “Find friends” feature allows you to choose to locate friends either through (i) your Contacts list, (ii) social media sites (such as Twitter or Facebook) or (iii) through a search of full names and usernames using Get@. If you choose to find your friends through your Contacts list, then you have agreed to provide our Services with full access to your Contacts list and have agreed to the storage and update of the list on our servers such that we can perform the search necessary to determine whether or not someone associated with the information you provide is using the Get@ app. We will use secure Internet protocols like https and make a good faith effort to hash the data so that any unauthorized access to the data during transmission and on our servers will not result in the information being compromised. If you choose to find your friends through social media sites, then you understand that the information these sites provide to conduct this type of search is governed by their privacy policies and your account settings on those sites. If you choose to find your friends through a search of names or usernames, then simply type a name to search in Get@ and see if that name or username is retrieved using our Services. Note that we do use any information contained in your Contacts list, or information from social media sites about your contacts, for any purpose other than to help you find friends on Get@.


Analytics information:


We may directly collect Data, or use third-party analytics tools and services for the collection of Data and other statistics about User Content and user experience, to help us measure traffic and usage trends for the Services and perform analytics. These tools collect information sent by your browser or mobile device, including the @surfaces and Items (URL links) that you visit and other information that assists us in improving the Services. We will make a good faith effort to collect, compile and report the analytics in aggregate form such that they cannot be easily manipulated to identify any particular individual user.


Cookies information:


When you visit the Services, we may send one or more cookies small text files containing a string of alphanumeric characters to your computer that uniquely identifies your Get@ app instance or web page and helps you log in faster and enhance your navigation through our Services. A cookie may also convey information to us about how you use the Services (e.g., the pages you view, the links you click and other actions you take on the Services), and allow us or our business partners to track your usage of the Services over time. A persistent cookie remains on your local device storage memory after you close your browser. Persistent cookies may be used by the Services on subsequent visits to the site. You have no control over the cookies used by the Services and should not use the Services if this is not acceptable. 


Log file information:


Log file time-stamped information and Data are automatically reported by the Get@ app, web site or mobile device each time you access or use the Services. When you use our Services, our servers automatically record certain log file information. These server logs may include information such as your web request, Internet Protocol (“IP”) address, browser type, referring /exit pages and URLs, taps on Get@ app screens, number of taps/clicks and how you interact with @surfaces and Items (URL links) on the Services, domain names, landing pages, pages and @surfaces/Items viewed, interactions with other Users, and other such information.



Device identifiers:


When you access the Services through a mobile device (including but not limited to smart-phones or tablets), we may access, collect, monitor and/or remotely store one or more “device identifiers,” such as a universally unique identifier (“UUID”). Device identifiers are small data files or similar data structures stored on or associated with your mobile device, which uniquely identify your mobile device. A device identifier may be data stored in connection with the device hardware, data stored in connection with the device’s operating system or other software, or data sent to the device by Get@. A device identifier may convey information to us about how you use the Services. A device identifier may remain persistently on your device, to help you log in faster and enhance your navigation through the Services. Some features of the Services may not function properly if use or availability of device identifiers is impaired or disabled.


Location data:


When you access the Services by or through a mobile device, we may access, collect, monitor and/or remotely store “location data,” which may include GPS coordinates (e.g. latitude and/or longitude) or similar information regarding the location of your mobile device. Location data may convey to us information about how you browse @surfaces /Item URLs and use the Services. Some features of the Services, particularly location-based services, may not function properly if use or availability of location data is impaired or disabled.


Commercial and marketing communications:


We use the information we collect or receive, such as your phone number or email address, to communicate directly with you. We may send you text messages or email containing newsletters, promotions, and special offers. If you do not want to receive such messages, you will be given the option to opt out. We also use your information to send you Services-related text messages or emails (e.g., account verification, purchase and billing confirmations and reminders, changes/updates to features of the Services, technical and security notices). You may not opt out of Services-related messages and/or emails. You may also be able to be “found” on Get@ based on information that you provide (see “Finding Your Friends on the Services”) above.


Use of certain service types of information we collect about you:


We use or may use cookies, log file, device identifiers, location data and clear gifs information to: (a) remember information so that you will not have to re-enter it during your visit or the next time you visit the site; (b) provide custom, personalized content and information; (c) to provide and monitor the effectiveness of our Services; (d) monitor aggregate metrics such as total number of visitors, traffic, and demographic patterns; (e) diagnose or fix technology problems; (f) help you efficiently access your information after you sign in; (g) to provide advertising to your browser or device, and (h) automatically update the Get@ application on your mobile devices.


Why the app asks for certain explicit permissions, either at installation time or after the app is opened:


The app needs access to your Contacts information and will ask for permission to access it if the "Finding your friends on the Services" feature described above is implemented and also in order to send SMS and other messages initiated in the app by you, as described above. 


Permission to access the Camera and Photos on your device is needed in order to allow you to upload profile and other photos as described above. This permission is also deemed to be implicitly granted whenever you invoke a choice in the app to upload such material.


Permission to access your current location is used to provide enhanced and personalized user services to you, as described in the "Location Data" section above.



Sharing of Your Information


We will not rent or sell your information (including User Content and Data) to third parties outside GetAt Inc. and its group companies (including any parent, subsidiaries and affiliates) without your consent, except as noted below:


• Who we may share your information with: We may share your information with third-party business partners and server administrators for the purpose of providing the Services to you. Such third parties will be given limited access to your information as is reasonably necessary to deliver the Services, and we will require that such third parties comply with this Privacy Policy, or operate under a similar privacy policy.


• Who can see User Content: Any User Content that you disclose by publicly posting using the Services will become available to the public and cannot be completely removed, except by GetAt Inc. at its sole discretion. Once posted using our Services, User Content may not be removable from public view using the Get@ app, as copies may remain viewable in cached and archived pages of the Services, on other sites that have republished us, or if other Users have copied or saved that information. Any and all User Content (whether publicly posted or not) may also persist and be stored permanently on our servers. If you do not wish your User Content to be available to the public, please don’t post it publicly on Get@ using our Services. Your username and, if you choose to disclose it, your full name, will be published publicly. Once published your username and/or full name may not be able to be removed.


• Who can see your IP address: We, including server administrators, can see your IP address when connected to our servers. Any third party service embedded in our Services such as an advertiser, video provider, social network or other third party will also have access to your IP address.


• Who can see your email address: If you enter an email address, administrators at GetAt Inc. including sever administrators will be able to see the email address so that they can contact and/or respond to you via email.


• Who can see your phone number used to sign up for a Get@ account: Your phone number that you provide during sign-up to establish a Get@ account is our primary means of identifying you and connecting your device to the unique username that you provide, since we send a One Time Password (OTP) code to your phone using the FaceBook Account Kit or Twitter Digits service to verify that a valid phone number that you can access was used for establishing the account. This information is provided to us and stored on our servers so that in the event of a logout from the account, either intentional or not, we can reconnect you to your account after verification using a fresh OTP. Facebook has its own policies regarding storage of the phone number and other sign-up/sign-in information that you can read here. Twitter also has its own policies for the Twitter Digits service which you can read here.


What happens in the event of a change of control:


We may buy or sell/divest/transfer our company GetAt inc. (including any shares in the company), or any combination of its products, services, assets and/or businesses. Your information such as customer names and email addresses, User Content, Data, and other user information and data related to the Services may be among the items sold or otherwise transferred in these types of transactions. We may also sell, assign or otherwise transfer such information in the course of corporate divestitures, mergers, acquisitions, bankruptcies, dissolutions, reorganizations, liquidations, similar transactions or proceedings involving all or a portion of the company.


Instances where we are required to share your information:


GetAt Inc. will disclose your information, including User Content and Data, where required to do so by law or subpoena or if we reasonably believe that such action is necessary to (a) comply with the law and the reasonable requests of law enforcement; (b) to enforce our Terms of Use or to protect the security, quality or integrity of our Services; and/or (c) to exercise or protect the rights, property, or personal safety of Get@ app and Services Users, or others.


Sharing certain service type information we collect about you:


We may share certain service type information, including Data, such as anonymous usage data, referring/exit pages and URLs, platform types, number of taps/clicks, etc. , obtained through tools such as cookies, log files, device identifiers, location data and clear gifs with our third-party business partners for the purposes described in the section above on “How We Collect and Use Information.” We may also aggregate or otherwise strip data of all personally identifying characteristics and may share that aggregated, anonymized data with third parties.


Ads on the Get@ mobile app and our Services:


We may also share certain information such as your location, app, and cookie data and Data relating to your use of our Services with our business partners to deliver advertisements (“ads”) that may be of interest to you. We may allow third-party ad servers or ad networks to serve advertisements on the Services. These third-party ad servers or ad networks use technology to send, directly to your browser or mobile device, the ads and ad links that appear on the Services, and will automatically receive your IP address or device identifier when they do so. They may also use other technologies (such as cookies, JavaScript, location data, and clear gifs, see above) to compile and store on our servers information about your browser’s or device’s visits and usage patterns on the Services and on other websites, and to measure the effectiveness of their ads and to personalize the advertising content delivered to you.


To enhance your user experience or help us improve and measure our effectiveness, we may embed code from third parties on the Services. These third parties may collect information about you including IP address, cookies, etc., in ways we do not control. The GetAt Inc. Privacy Policy does not apply to, and we cannot control, the activities of third parties. Please consult the respective privacy policies of such third parties or contact such third parties for more information.


How We Store and Protect Your Information


Storage and Processing:


Your information collected through the Services may be stored and processed in the United States or any other country in which GetAt Inc. or its subsidiaries, affiliates, or service providers maintain facilities. We may transfer information that we collect about you, including personal information, to affiliated entities, or to other third parties across borders and from your country or jurisdiction to other countries or jurisdictions around the world. If you are located in the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that we may transfer information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction, and you consent to the transfer of information to the U.S. or any other country in which GetAt inc. or its parent, subsidiaries, affiliates, or service providers maintain facilities, and the use and disclosure of information about you as described in this Privacy Policy.


Keeping your information safe:


We care about the security of your information and data, and use commercially reasonable safeguards in a good faith effort to preserve the integrity and security of all information and data collected through the Services. To protect your privacy and security, we take reasonable steps (such as sending a OTP to the phone number specified at sign-up) to verify your identity before granting you access to your account. You are responsible for all activities on our account including maintaining control over who accesses the phone number used for account setup and for providing account and profile information, and for controlling access to your email communications from us, at all times. Please note however that GetAt Inc. cannot ensure or warrant the security of any information and data you transmit to us . Also, we cannot guarantee that information and data on the Services will not be accessed, disclosed, altered, destroyed, or hacked. Your privacy settings may also be affected by changes to the functionality of third party sites and services that you add to our Services, such as social networks. We are not responsible for the functionality or security measures of any third party.


Compromise of information:


In the event that any information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation and where appropriate, notify those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations.


Your Choices about Your Information


You control your account information and settings: You may update your account information and email communication preferences at any time by logging in to your account and changing your profile settings. You can also stop receiving promotional email communications from us by selecting the unsubscribe option in any email that you may receive from us after modifying your profile and removing your email address.


We make every effort to promptly process all unsubscribe requests. As noted above, you may not opt out of Services-related communications, e.g., account verification, purchase and billing confirmations and reminders, changes/updates to features of the Services, technical and security notices, that may be sent to you by text message and/or email, as applicable. If you have any questions about reviewing or modifying your account information, you can contact us directly at feedback@getatapp.com.


Please note that any information from your profile that was previously available publicly at any time may still be permanently and indefinitely available via our servers and on other users' Get@ accounts, as described above in the "Sharing of Your Information" section.


How long we keep your User Content and Data:


Following termination or deletion of your User Account, we may retain your User Content and other information for a commercially reasonable time for backup, archival, or audit purposes, with both duration and nature solely at our discretion. However, please note that any User Content that you previously (or at any time during your use of your Get@ account) chose to make public using the Services may not be removable and may persist permanently and be indefinitely available via our servers and on other users' GetAt accounts, as described above in the "Sharing of Your Information" section.


User Content and Data may also have been stored in server backups or archived permanently, and this will remain accessible to our server administrators and other authorized company personnel, solely at our discretion.



Children’s Privacy


We do not knowingly collect or solicit any information from anyone under the age of 17 or knowingly allow such persons to register as Users. The Services and their content are also not directed at children under the age of 13. In the event that we learn that we have collected personal information from a child under age 13, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 13, please contact us in writing at our company address of record.


Links to Other Websites and Services


We are not responsible for the practices employed by websites or services linked to or from the Services, including the information or content contained therein. Please remember that when you use a @surface or Item link to go from the Services to another website, our Privacy Policy does not apply to third-party websites or services. Your browsing and interaction on any third-party website or service, including those that have a link or advertisement on our websites or in the Get@ app, are subject to that third party’s own rules and policies. In addition, we are not responsible and we do not have control over any third parties that you authorize to access your User Content. If you are using a third-party website or service and you allow such a third-party access to your User Content, you do so at your own risk.
